Erm... these are shareware games that we're talking about. They're specifically designed to be given out and (with permission) put on CD packs. Shareware isn't very common anymore because most game companies are affluent enough to afford commercials, but back in the days of DOS it was the primary way of finding out about games. And no, it's not illegal... it's just that getting a CD together would mean getting permission from ~350 seperate authors, which is a pain in the ass.
Example: Emmzee would have to not include any Epic shareware games, as Epic's License Agreements prohibit including their shareware on CD's with over 10 games on it (unless you get special permission).
